Can a landlord evict me straight away after the section 21 notice period has ended or does he have to get a Court Order first?
Your answer
He has to get a Court Order first.
There are only two ways that a landlord can, legally, recover vacant possession of his property:
You (the tenant) moving out voluntarily, or
By using the Court Bailiffs or High Court Enforcement Officers acting after your landlord has obtained a possession order.
If your landlord tells you otherwise, this is harassment which is a criminal offence. You can complain about it to your Local Authority who have the power to bring a prosecution.
You can also seek compensation particularly if your landlord actually evicts you without getting a Court Order first. One of the organisations in our guide below should be able to help you.
