I would like to sublet one of the rooms in a property I have rented from a landlord, can I do this?

Almost certainly not.  If you have a written tenancy it will almost certainly prohibit subletting.  

There are a number of very good reasons why most landlords will forbid subletting, for example:

  • It will usually invalidate their insurance policy
  • If they have a mortgage their mortgage terms and conditions will invariably forbid this
  • Bringing another occupier into the property may turn it into an HMO which most landlords will not want 

If you go ahead with the subletting without your landlord’s permission you will be in breach of your tenancy which will give your landlord grounds to evict you and also, maybe, obtain an injunction ordering you to stop.

Note also that if your lodger or tenant causes any damage to the property, you will be liable for this to your landlord.
